RE: Canton Lake Water Levels
Dear Ray:
As I have not heard from you in response to my letter of
September 23, I am assuming that you are not agreeable
to the changes in the Canton Lake water level order
suggested by the Department of Inland Fisheries and
Wildlife. These changes included completing the fall
drawdown by November 1 and completing the spring refill
by May 15.
Therefore, the current State water level order for Canton
Lake, dated September 13, 1978, and the DEP's Canton Lake
Water Level Management Plan, dated August 30, 1996, remain
in effect and will be enforced by the DEP until rescinded
or amended.
The DEP has standing legal authority, after written notice
and opportunity for a hearing, to modify the current
water level order if we find that there has been a change
in any condition or circumstance that requires a temporary
or permanent modification of the terms of the order. See
Title 38 M.R.S.A. §341-D(3).
In addition, the DEP must hold a new hearing to consider
changes to the current water level order upon petition
from any of the following: you, as the dam owner; the
Commissioner of Inland Fisheries and Wildlife; at least
50 shoreline property owners; or the Canton Water District,
as a chartered public water company having withdrawal
rights to Canton Lake. See Title 38 M.R.S.A. § 840(1).
In the meantime, I trust you will continue to operate
the Canton Lake Dam to keep the lake in compliance with
the current water level order.
